Trump is down three lawyers on a net basis, but he has what he wants: Attorneys who'll argue using his (Trump's) own words and strategy.
Trump isn't any smarter than he was on Saturday, when his five lead lawyers bounced because their delusional client insisted that the trial strategy had to be that the election was stolen from him. Oh, and because Trump didn't want to pay $3 million in expenses.
We've read that none of those lawyers walked away with compensation, which seems impossible.
On Tuesday, the new defense lawyers rushed out a brief of 14 pages saying that Trump shouldn't be impeached because he's no longer President, and then wasted some words on how the election was stolen. The former is a weak argument and the later is fantasy, but their hands were tied.
Mind you, Trump's lawyers didn't spend much verbiage on the stolen election. They argued about the President's civil liberties, saying that the President has a right to say what he wants to say under the First Amendment. The crowd was supposed to be peaceful. Silly them, breaking into the Capitol looking to hand Mike Pence and execute any number of Democratic lawmakers.
On the prosecution side, Democrats produced a brief of 80 pages on Monday saying, among other things, "If provoking an insurrectionary riot against a Joint Session of Congress after losing an election is not an impeachable offense, it is hard to imagine what would be." The President was "singularly responsible" for the event.
Democrats may be fighting a losing battle with hopelessly, almost unbelievably corrupt Republican Senators. But at least they are standing up to Trump!
Republicans, for their part, seem determined to follow the orange pied piper right over a cliff. Wherever they land, their fall will leave them tarnished till the end of history.
Is it wise for Trump's lawyers even to mention Trump's cockamamie ideas about election fraud?
Is there anything that can cut through the Republican blind side on how serious the cost of their compliance with Trumpists will be? Can you think of anything that could happen to change the Republicans' minds on acquitting Trump?
